Welcome. You have arrived at a website provided by the Building Industry Association of Southern California (“BIASC”). We respect your privacy and want to protect your personal information.

This Privacy Policy (this “Privacy Policy”) describes the way in which BIASC collects, uses and discloses information about you, including personally identifiable information, in connection with your use of the website https://biasc.org (the “Site”).  Throughout this Privacy Policy, “you” refers to the individual or entity that is visiting the Site.

 

Please read this Privacy Policy carefully before accessing or using the Site.  By accessing the Site, registering as a user, using any of the publicly available content, services and or products provided through the Site (collectively, the “Services”) or by otherwise submitting your personal information to BIASC, you acknowledge and consent, as described in this Privacy Policy, to the collection, use, sharing and disclosure of your personal information and data on and in connection with the Site and the Services.

  1. This Privacy Policy..
    1. Scope. BIASC utilizes the Site to provide you with certain Services.  In the course of providing the Services, BIASC may collect “Personal Information, which means information that personally relates to or identifies you, including without limitation your name, age, gender, email address, postal mailing address, zip code, home/mobile telephone number, and other types of information from you.
    2. Changes to this Privacy Policy. BIASC reserves the right to update this Privacy Policy from time to time by posting a new Privacy Policy on this page.  In some cases, where the changes to this Privacy Policy are material, BIASC may also contact you via electronic mail or post a notice on the homepage to let you know of such changes.  You are advised to consult this Privacy Policy regularly for any changes.  Your continued use of the Site after such changes have been made constitutes acceptance of those changes.

  1. Collection of Information.
    1. Information that You Provide. When you register for an account on the Site, BIASC collects certain Personal Information from you that you voluntarily provide to open an account, transact business, communicate with BIASC, verify your identity and fulfill legal and regulatory requirements.  From time to time, BIASC may request additional information to help it further assess your needs and preferences.  BIASC may also collect information that you provide by electronic mail, telephone or other means.
    2. Automatically Collected Information. BIASC may automatically collect certain technical information from your computer or mobile device when you use the Site, such as your Internet Protocol address, your web browser type and version, the name and version of your operating system, the pages you view on the Site, the pages you view immediately before and after you access the Site, and the search terms you enter on the Site.  This information allows BIASC to recognize you and personalize your experience if you return to the Site using the same computer or mobile device, and to improve the Site and the Services.
    3. Information about Legal and Other Materials. In addition, BIASC may collect technical information from your computer or mobile device concerning your receipt of communications, access to materials and approval or execution of contracts, consents or other statements or agreements by means of the Site, including the Site’s Terms of Use (“Terms”) and this Privacy Policy.
    4. Cookies. BIASC may collect this information using “cookies,” which are small text files that the Site saves on your computer or mobile device, or similar technologies.  You can disable cookies in your browser settings, but doing so may affect the functionality of the Site.  BIASC may also collect information using “web beacons,” which are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular website tied to the web beacon, and a description of a website tied to the web beacon or using unique links that can distinguish when individual users click the link.  Web beacons and unique links, alone or in conjunction with cookies, may help BIASC compile information about your interactions with electronic mail sent to you in connection with the Services.  For further information, see the Cookie Policy in Section 5 below.
    5. Cross-Site Tracking. BIASC does not utilize technical measures on the Site to track your activities across different websites or online services, whether you configure your browser’s Do Not Track feature or otherwise.  The Site does utilize third-party application programming interfaces controlled by third parties, such as to display maps and graphs, that may attempt to track your activity across other websites that utilize those interfaces.
    6. Reviewing, Correcting and Deleting Information. You may update or correct contact information and other Personal Information stored about you on the Site, or delete your account in its entirety, by accessing your account/profile page, or by sending a written request to the BIASC at lmeadows@biasc.org.

  1. Use and Disclosure of Information. BIASC may collect, use, share, and otherwise process your personal information for a number of purposes, including, but not limited to:
    1. Accessing the Site and Providing the Services. BIASC uses your Personal Information to provide you with the Services, or products, services or information related to the Site or the Services, including:
      • providing you with information about the Site, Services or required notices;
      • customizing your experience when using the Site, such as by providing interactive or personalized elements on the Site;
      • more effectively marketing and advertising BIASC;
      • better determining which Services may be of most interest to you; and
      • providing you with content based on your interests.
    2. Analysis. BIASC may use your Personal Information for improving the Site and/or the Services, including by (i) combining or aggregating any of the information collected through the Site or elsewhere for generating and analyzing statistics about your use of the Site and user demographics and traffic patterns and (ii) using anonymized data that may or may not be derived from Personal Information but does not personally identify you, both for disclosure to third parties and for the purpose of enhancing the Services and developing new offerings.
    3. Security. BIASC may use your Personal Information for safety and security purposes, including sharing of your information for such purposes, when it is necessary to pursue BIASC’s legitimate interests in ensuring the security of the Site and Services, including detecting, preventing and responding to fraud, intellectual property infringement, violations of the Terms, violations of law or other misuse of the Site; and when BIASC believes in good faith that disclosure is necessary (i) to protect BIASC’s rights, the rights of other users of the Site, the integrity of the Site, or your safety or the safety of others, or (ii) to detect, prevent or respond to fraud, intellectual property infringement, violations of the Terms, violations of law or other misuse of the Site.
    4. Service Providers. BIASC may engage third-party service providers (such as payment processors, hosting providers and analytics and security providers) to assist in operating and marketing the Site. BIASC’s engagement of third-party service providers may sometimes be necessary for BIASC to provide the Services to you, particularly where such third-party service providers ensure that the Site and Services are operating and secure.  In other instances, although not necessary as described in the previous sentence, the engagement of such third-party service providers allows BIASC to more effectively serve its customers and improve the Site and the Services.
    5. Other Disclosure. BIASC may disclose Personal Information about you to others: (i) with your valid consent to do so; (ii) to comply with a valid subpoena, legal order, court order, legal process, or other legal obligation; (iii) to enforce any of the terms and conditions or policies; (iv) as necessary to pursue available legal remedies or defend legal claims; or (iv) as is otherwise legally permissible and not in violation of the Terms, this Privacy Policy or any other applicable agreement.
    6. Marketing. If you submit your information to BIASC, BIASC may provide you with information about the Site, Services or required notices.  In addition, BIASC may use collected information for delivering marketing communications that may be of interest to you.

  1. Storage.
    1. Jurisdiction. Information collected through the Site will be stored in, processed in and subject to the various local, state and federal laws of the United States, which may not provide the same level of protection for your information as your home country, and may be available to the United States government or its agencies under a lawful order made in the United States. By using the Site, you consent to such transfer to, storage in and processing within the United States.
    2. Security. BIASC is committed to protecting your information from unauthorized access, use or disclosure. Reasonable administrative, technical and physical safeguards designed to protect the information collected through the Site are maintained. For example, all information you transmit to the Site is encrypted using Transport Layer Security technology (TLS)
    3. Retention. BIASC will not retain data longer than is prohibited by applicable laws or regulations, if any. If you wish to access or correct any information BIASC holds about you, you may have your data deleted, blocked or corrected, in each case in accordance with any applicable laws or regulations, if any, please contact us at lmeadows@biasc.org. BIASC also collects and retains information through the Site in an anonymized form, i.e. tracking the pages you visit and how long was spent on each page.

  1. Cookie Policy. This section provides BIASC’s cookie policy and describes how BIASC uses Cookies and similar technologies.
    1. Cookies. Cookies are small pieces of data that are stored on your computer, mobile phone, or other device when you first visit a page. BIASC may use cookies, web beacons and similar technologies (“Cookies”) to enhance your user experience, understand your usage of the Site and Services and to perform analytics. Cookies may also be set by other websites or services that run content on the page you are visiting. The provision of your data via Cookies is voluntary except for those Cookies that BIASC places on your device because it is necessary for the performance of the Site or Services. BIASC may use “session cookies” and “persistent cookies.” Session Cookies are temporary Cookies that remain on your device until you leave the Site or Services. A persistent Cookie may remain on your device for much longer until you manually delete it.
    2. Use. Cookies can contain the following information about you and your use of the Site: browser type, search preferences, data relating to which pages of the Site that you have visited and the date and time of your use. BIASC may use Cookies for the following purposes:
      • to enable and support security features, prevent fraud, and protect your data from unauthorized access;
      • to enable features and help BIASC provide you with personalized content; and
      • to analyze how you use the Site and to monitor Site performance, as these Cookies help BIASC to identify and fix errors, understand and improve services, research and test out different features, and monitor how you reached the Site.
    3. Third-Party Cookies. BIASC uses certain third-party Cookies on the Site, including without limitation the following:
      • Google Maps and Google Charts. The Site utilizes mapping and charting services from Google. These services use cookies in their internal operations. See https://policies.google.com/privacy for details.
      • DocuSign (if applicable). The Site may provide the option to execute agreements via DocuSign. If you interact with DocuSign via the Site, you may encounter cookies used by DocuSign in their internal operations. See https://www.docusign.com/privacy for details.
      • Wistia, YouTube, and Vimeo. The Site offers the capability to embed video from Wistia, YouTube, or Vimeo as part of offering marketing materials. If you view marketing materials containing embedded video, the video player may use cookies in its internal operations, including functions such as tracking how many visitors play the video, and how much of the video they play.     4. Opting Out. You can control and/or delete cookies as you wish.  For details on how to do this, you can visit online https://www.aboutcookies.org/ and numerous other websites.  You can delete all cookies that are already on your computer and you can set most browsers to prevent them from being placed. If you do this, however, you may have to manually adjust some preferences every time you visit a Site and some services and functionalities may not work as intended by BIASC.
  1. Third-Party Website. The Site and communications from BIASC may contain links to websites operated by third parties.  BIASC does not control how these third parties collect information or by what means such third parties may use their own cookies to collect information about you.  You acknowledge and agree that BIASC is not responsible for the collection and use of your information by such websites that are not under BIASC’s control.  BIASC encourages you to review the privacy policies of each website you visit.

 

  1. Children’s Privacy. BIASC recognizes the importance of children’s safety and privacy. The Site is not designed to attract children and is not intended for use by any children under the age of 13, nor does BIASC request or knowingly collect, any personally identifiable information from children under the age of 18. Minors under the age of 18 (but older than 12) may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by the Site’s Terms. If you are the parent or guardian of a child under 13 who has provided her or his information to us, please contact us at lmeadows@biasc.org to request the deletion of that information.
  1. International Visitors. The Site and the Services may be accessed and/or used by users located outside the United States in accordance with the Terms and other policies and procedures posted on the Site, if any.  If you use the Services from the European Union (EU) or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States and by providing your personal information on or through the Services you consent to that transfer.
  1. Other Agreements. You may from time to time enter into binding legal agreements relating to certain Services available through the Site, which may have terms that are different from those of this Privacy Policy.  In the event of any inconsistency, the terms of such other agreement shall control with respect to such Services.

Your California Privacy Rights – Privacy Notice for California Residents

BIASC collects certain types of personal information about you during your relationship with BIASC as a user or visitor. Under California law, if you are a resident of California, you have the right to request certain information that we collect about you, including:

  1. The categories of Personal Information we have collected from you;
  2. The categories of sources from which we collected the Personal Information;
  3. The business purpose we have for collecting or sharing that Personal Information;
  4. The categories of third parties with whom we share such Personal Information; and
  5. The specific pieces of Personal Information we have collected about you.

In addition, you may request that we provide you with:

  1. The categories of Personal Information that we sold about you, and the categories of third parties to whom the personal information was sold, by category or categories of Personal Information for each category of third parties to whom the information was sold;
  2. The categories of Personal Information that we have disclosed about you for a business purpose;
  3. The category or categories of consumers’ Personal Information that we have sold, or if we have not sold consumers’ Personal Information; and
  4. The category or categories of consumers’ Personal Information that we have disclosed for a business purpose, or if we have not disclosed that information for a business purpose.

Please note that if we collected information about you for a single one-time transaction and do not keep that information in the ordinary course of business, that information will not be retained for purposes of a request under this section. In addition, if we have de-identified or anonymized data about you, we are not required to re-identify or otherwise link your identity to that data if it is not otherwise maintained that way in our records.

As a California resident, you also have the right, at any time, to tell us not to sell Personal Information – this is called the “right to opt-out” of the sale of Personal Information.  You also have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

You may make a written request to us at lmeadows@biasc.org to request this information. We may require you to confirm your identity and your residency in order to obtain the information, and you are only entitled to make this request twice a year. You may call, email or write us with your request as set forth above or at the contact information below. Please include “California Privacy Rights” as the subject line. You must include your full name, email address, and attest to the fact that you are a California resident by including a California postal address in your request. We will respond to your request within 45 days or let you know if we need additional time.

Your Nevada Privacy Rights

If you are a Nevada resident, you have the right to request certain information from us regarding the collection and sale of your personal information (as defined in Nevada Revised Statutes 603A.320) during your visit to our website or when you otherwise interact with us online. If you have sought or acquired, by purchase or lease, any goods or services for personal, family, or household purposes from the Site, you may ask us to disclose whether we have sold (for monetary consideration) certain information about you (including your first and last name, physical address, email address, telephone number, social security number, an identifier that allows you to be contacted either physically or online, or other contact information that allows us to identify you personally).

As a Nevada resident, you may also request to opt out of us sharing such information about you.  To make this inquiry, please submit a request in writing to lmeadows@biasc.org with “Nevada Privacy Rights” in the subject line. You must include your full name, email address, and attest that you are a Nevada resident by providing a Nevada postal address in your request. Please state whether you are requesting information and/or opting out.

We will process your request within 60 days, or we will let you know if we need additional time. We may require additional information to verify your identity before we can respond.
